§ 52.123. DISCHARGE AS AN ENDANGERMENT.

- If, in the opinion of the Authority or the Authority Manager, any discharge of pollutants to the POTW reasonably appears to present an imminent endangerment to the health or welfare of persons, the Authority or the Authority Manager shall notify the user responsible for the discharge that it must take immediate action to abate the risk, including the cessation of the discharge endangering the health or welfare of persons. If the user does not immediately respond to the notice, the Authority or the Authority Manager shall be authorized to take the actions as are necessary to halt or prevent any such discharge, including emergency suspension of service. This shall be known as the Authority’s emergency authority.(1995 Code, § 58-374) (Ord. passed 5-22-1995)
