§ 50.032. ENUMERATION OF RATES.

  • (A) Generally. Rates to be charged for service furnished by the system shall be as follows.
    (B) Specifically.
    (1) Water service use charges. Water service use charges are as follows.
    (a) The base rate for water service in the city shall be as follows:

    * $28.50 of the base rate per quarter per 3/4 equivalency is for debt service. The water commodity rate shall be $4.50 per 1,000 gallons; $2.00 per 1,000 gallons of the water commodity rate is for debt service.
    (c) The city shall have the right to adjust the user charge by resolution of a majority vote of the City Council, based on an annual audit review of the water system operation and maintenance costs. The review shall be conducted annually by the Authority.
    (2) Connection charges. For each direct connection to lines of the city’s existing water system, as built, there shall be charged a fee of $2,000 per single-family residential equivalent user, for those premises or buildings which desire water service and are located within the corporate limits of the city. For those premises located outside the corporate limits of the city, the fee for connection to the water system shall be $4,000 per single-family residential equivalent user. The fee shall be a fee imposed by the city for the privilege of connecting to the city’s existing water system, and shall be expressly for the purpose of recovering the capital cost of installing the system.
    (3) Indirect connection. In order to defray the proportional share of the cost of the necessary oversizing of the distribution and transmission lines of the water system, any booster or pump stations, water production facilities, including, but not limited to, wells and water treatment facilities, there shall be imposed a fee, for each indirect connection to the system at any time hereafter, of $1,000 for each residential single-family equivalent user. An indirect connection shall be defined as a connection to a line which is installed to serve more than one property, the cost of which is paid for by special assessment or private funds and constructed in accordance with all applicable state, county, and local codes, ordinances, and regulations, and is added to the original system after its construction.
    (4) Equivalent user factor. Each premises, other than a single-family residence, shall pay either a direct or indirect connection charge, multiplied by a factor representing a ratio of water use by the class of premises to normal single-family residential use, as reflected in § 50.033.
    (5) Certified meter agreement for water connections. All commercial and industrial users shall have the option to prove their residential equivalency and connection charge to the system by readings taken from a certified water meter. That agreement shall read as follows:
    “I/we hereby agree that I/we choose to prove my/our residential equivalency and connection charge to the Douglas water system by readings taken from a certified water meter.
    I/we understand that I/we will purchase the necessary water meter from the Kalamazoo Lake Sewer and Water Authority and I/we will pay for the installation costs of the meter if there are installation costs resulting from any necessary replumbing.
    I/we understand that after the certified water meter is installed, the water flow to the property shall be accurately recorded for a period of two years. At the end of the two-year period, the property owner’s residential equivalency will be determined by dividing the average annual water purchased by 58,765 gallons. The resulting number will be the residential equivalency.
    Until the two-year proving period has expired, the residential equivalency, as determined by the authority manager, will be correct until proven different. After the two-year period, the connection charge will be readjusted accordingly.
    After the two-year period, the water meter shall become the property of the Kalamazoo Lake Sewer and Water Authority.”
    (6) Payment of connection charges. Connection charges, as set forth in this section, shall be due and payable in cash upon application for connection to the system. In addition, the cost of labor, connecting pipe, fittings and appurtenances, and installation, plus 30% of these costs, shall also be paid by the prospective user. Applications for service connections shall be made to the Authority prior to making the connection, upon forms furnished by the Authority at which time the applicant shall pay the connection charge, as set forth in this section, plus $400 which is the estimated cost of the actual connection thereof subject to refund or additional charge after the actual cost has been determined.
