§ 93.058. EXCEPTIONS.

  • (A) Pursuant to a PUD approval, the City Council may modify the standards for new public streets for a given project for good cause shown.
    (B) The City Council reserves the right to place higher design requirements and standards on a development that provides access by means of a public street should it be in the best interests of the city and for the protection of the health, safety and general welfare of its residents. Such additional requirements and standards shall be recognized and accepted by professional associations and engineering societies, including but not limited to: the American Association of State Highway and Transportation Officials, the American Society of Civil Engineers, the Institute of Transportation Engineers, the Building Officials and Code Administrators International (BOCA) and the National Fire Protection Association.
    (C) For situations involving existing nonconforming private streets, the City Council may grant design modifications should it determine that the design requirements and standards sited herein cannot reasonably be met due to a physical hardship. Should the City Council grant design modifications, it may impose reasonable conditions upon the affected property and public street that protect the public health, safety and general welfare of all city residents.
